And The Winner Is Electronic Cigarette

In a decision that astonished many of us, the Food & Drug Administration on Monday announced they’d stop trying to regulate the e-cig as drug delivery products. They will instead be regarded as tobacco products and come under the rules of the “Family Smoking Prevention & Tobacco Control Act”. Introduced last year, this act gave the FDA power to regulate numerous areas of the tobacco trade such as the way they advertise and sell their products.

Up to now, electronic cigarettes have been inside a sort of grey-area in the law. The Food and Drug Administration first attempted to categorize them as drug delivery products and force them to successfully pass extensive medical testing and an application process just like pharmaceutical products. The ecig companies fought back and won an appellate court verdict in December of 2010 preventing the Food & Drug Administration from classifying them as drug delivery devices. Many of us suspected their attempt to control e-cigs was probably motivated by pressure from cigarette manufacturers.

Monday was the deadline for the Food & Drug Administration to make a decision whether to appeal last December’s verdict to the U.S. Supreme Court and label ecigs as a pharmaceutical. Recognizing they would most likely lose yet another courtroom battle, they went with the tobacco classification. Smokeless cigarette vendors and vendors worldwide applaud the latest decision.

I spoke with the owner of the USA’s biggest Smokeless Cigarette/E-Liquid vendor Jeffrey Eaton. He said “We are all ecstatic over here at WordUpEcig.com. We have worked so hard to put our brand on top of the others and now we no longer have to worry about the FDA putting unnecessary restrictions on us.” He also feels this will likely place pressure on the many sellers of counterfeit products either to step up their act or get out of the industry. His sentiments are most likely embraced amongst all electric cigarette vendors.

For now it appears as if e-cigarettes are not going away soon. The Food & Drug Administration says on their website that as long as smoke-free cigarettes are not promoted as having any type of therapeutic value, such as a nicotine substitute or stop smoking product, they’re going to be considered like a tobacco product. I think we ought to all offer a big thumbs up to the countless users, retailers and manufacturers of e-cigarettes that struggled for this ground breaking decision!

FDA Lies About Electronic Cigarettes

The e-cig controversy went viral around July of 2009 once the Food and Drug Administration released an investigation on smokefree cigarettes and their corresponding nicotine containing solution e juice identifying them as hazardous because they contained chemical substances regarded as poisonous to humans. The e cig enthusiasts fired back by appointing a prominent analysis firm to examine the FDA report and the techniques applied to obtain their conclusions. This firm found the conclusions obtained by the FDA study seemed to be invalid because the diagnostic techniques they employed had been far from those needed to produce these kinds of conclusive determinations.

So at present, more than a year after, exactly what have we learned about the safety of smokeless cigarettes? Well, quite simply, not much has changed.
