In a decision that stunned everyone, the FDA just declared they would stop seeking to regulate smokeless cigarettes as pharmaceutical delivery products. They will instead be considered tobacco products and come under the jurisdiction of the “Family Smoking Prevention & Tobacco Control Act”. Ratified in 2009, this act gave the FDA capacity to control many areas of the tobacco marketplace including how they market and sell their products and services.

Until now, Smokeless Cigarette have been within a type of grey-area of the the legal system. The FDA first attempted to label them as drug delivery systems and require all of them to successfully pass comprehensive scientific studies with an application process exactly like prescribed drugs. The ecig firms fought back and landed an appellate court judgement in December of 2010 halting the Food & Drug Administration from categorizing them as prescription drug delivery systems. Many thought this attempt to regulate e-cigs was probably motivated by pressure from tobacco manufacturers.

Monday was the deadline for the Food & Drug Administration to define their decision whether to appeal last December’s verdict to the U.S. Supreme Court and classify smokeless cigarettes as a drug. Knowing that they’d most likely lose yet another legal challenge, they went with the tobacco classification. Ecigarette companies and vendors globally applaud the new decision.

I spoke with the owner of the USA’s largest Smokeless Cigarette/Eliquid dealer Jeffrey Eaton. He was quoted saying “We are all ecstatic over here at WordUpEcig.com. We have worked so hard to put our brand on top of the others and now we no longer have to worry about the FDA putting unnecessary restrictions on us.” He also believes this will likely put pressure on the numerous sellers of fake products either to step up their act or get out of the business. His feelings are probably embraced among all e-cigarette companies.

For now it appears like electronic-cigs are here to stay. The Food & Drug Administration states on their site that as long as smoke-free cigarettes are not marketed as having any sort of medical value, for example a nicotine substitute or smoking cessation product, they’ll be treated as a tobacco product. I think we need to all give a big thumbs up to the numerous customers, dealers and manufacturers of e cigs that struggled for this ground breaking decision!

The FDA has decided to appeal the final decision of the U.S. District Court which ruled they have no jurisdiction over the sales of the e-cig. The District Court ruled that since the newest stop smoking product isn’t deemed a medicinal therapy, the FDA lacks the authority to regulate and control them. The FDA has taken issue concerning the Court’s ruling despite the fact they agree the Electronic Cigarette would in fact be valuable for smokers wanting to give up smoking cigarettes just as methadone helps opioid addicts with their dependence.

For anyone unfamiliar with this new product, it has grown into the most innovative smoking cessation product since the introduction of NRT (nicotine renewal therapies). It is a battery run device which was engineered to completely look like a cigarette. As soon as the user inhales a breath from the unit, it gives off a little shot of water vapor containing exclusively nicotine. These devices are refillable as well as rechargeable making them a lot less expensive than using tobacco. One of the benefits about their design is the fact that the nicotine refills can be bought in several strengths from 100 mg to zero mg nicotine allowing the smoker to over time taper off nicotine without having withdrawal discomforts.

People who smoke spend well over $1.6 billion dollars yearly for stop smoking products. Add in the $20 billion per year smokers invest in cigarettes and you will see how manipulating the esmoke industry may be motivated by more than the FDA’s concern in the health and safety of US citizens. People that use the electric cigarette realize this ulterior motive and have turned into a fierce and formidable group which demand the FDA consider e-cigarettes to be a healthier substitute for cigarettes. Opponents of the smokeless cigarette, including the ALA (American Lung Association) and FDA, would like them restricted unless their safety can be established.

The Food and Drug Administration has attempted more than once to gain regulation of the esmoke. The initial attempt was noting a currently debunked analysis claiming that the nicotine liquid used to re-fill the ecig contained hazardous contaminants. Research backed by a large smokefree cigarette vendor has since revealed the FDA’s research practiced flawed technological analysis procedures and thus is invalid. Now, the ruling against the Food & Drug Administration’s allegation that smokefree cigarettes are health related products seems to be yet another nail in the coffin of the Food & Drug Administration’s effort to control them.

There are definitely a few unknowns linked to the smoke free cigarette like the long term results of their use. But the fact remains, they’re by far a significantly better alternative to using tobacco. Rather than the Food and Drug Administration spending hundreds of thousands of taxpayer dollars on court fees to gain control of the e-cig, perhaps they should begin a comprehensive study of their health impact. That is if, of course, they’re genuinely concerned with the health and well being of smoke-free cigarette users.

The smoke free tobacco showdown just erupted due to the addition of yet another contender. The pharmaceutical icon GSK (Glaxo Smith-Kline) has loaded their big guns and is going to be aiming straight at the newest orally dispersed nicotine supplements made by RJR (R.J. Reynolds). GSK has demanded the Food and Drug Administration request R.J. Reynolds to remove its orally dispersed nicotine products entirely from the marketplace. Even though still under assessment from the FDA, RJR has released their dissolvable tobacco products into test segments all around the country.

The pharmaceutical corporation takes issue with the simple fact that before GSK had been permitted to release their nicotine-replacement therapies, they were required to pay out millions of dollars performing medical tests the FDA said were needed due to safety reasons. GSK questions why RJR has been permitted to begin selling their products although not spending money on safety trials. Especially troubling to GSK is the fact RJR is in fact advertising its product to be a tobacco cessation aid as well as a safer, healthier replacement for tobacco use.

This controversy with smoke free nicotine products is actually not new. Since the late 90s the Food and Drug Administration, together with Local, State and Federal jurisdictions, have been attempting to prevent the sales of items including the electronic cigarette in addition to dissolvable tobacco products. Opponents claim that these smoking substitutes can become a “gateway” product leading children along with non-smokers to eventually take up cigarette smoking. All of the currently available smoking substitution products continue to contain the terribly addictive element nicotine.

GSK calls RJR’s claims that their latest product may be used to quit smoking an “untested promotional tactic”. GSK suggests “there are significant opportunities to boost the impact of current stop smoking tools, including expanding access to and use of NRT techniques.” Basically, GSK believes their comprehensively tested NRT products should not have to compete with untested and perhaps harmful things like dissolvable tobacco and the e-cigarette.
